Terms of service and Conditions
§1. Overview
- Terms of service and Conditions apply to all users of this website. It defines condition in which user can receive Newstletter, digital and physical goods from us. As us we define BONEIO LTD., located in Łódź, Poland. More info about company in Definitions.
- By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms and Conditions”, “Terms”)
§2. Definitions
In terms of service we use following definitions:
- Seller – BONEIO LTD, Aleja Tadeusza Kościuszki numer 101, 90-441 Łódź, registered by the National Court Register kept by District Court Łódź-Śródmieście, XX department, KRS number 000098597, EU Vat no 7272861352, Regon 522762415, share capitals of 50 000 zł fully payed. Storage facility is located at: ul. Wólczańska 265, 93-035 Łódź
- Client – a natural person holding full capacity for legal actions, and a legal person or organisation unit not holding a legal personality, holding capacity for legal actions, which uses website to register into Newsletter or buy goods through our store.
- Consumer – a natural person concluding an agreement for the purpose of buying goods from store, which are outside his trade, business or profession.
- Trader with consumer rights – any natural or legal person which buys goods in the store directly or indirectly related to their business (eg based on CEIDG register).
- User – natural person who subsribe for Newsletter (if available).
- Website – website provided by the seller: https://boneio.eu
- Store – online shop provided by the company, available at: https://store.boneio.eu
- Goods – physical product which can be buy by the Client and sell by the Seller.
- Newsletter – digital goods which can be provided by email to the users who opted in.
- Digital environment – computers, software and network connection used by Consumer to access and use digital content provided by Seller.
- Cart – part of the online store, where Client can see/modify/add/remove items, which he/she chosen to buy
- Order form – form available on boneIO store website, which allows to create order with goods sold by store and establish terms and conditions of payments and shipping details.
- Subscription form– form available on boneIO websites which allows to subscribe for Newsletter.
- Register form– form which allows to create account on boneIO store website.
- Account – account in boneIO store which client may or may not create, on which data are gathered about orders placed by client.
- Order – will mabe by Client created by Order form, which allows to create Contract.

- PayNow – mElements S.A.
- AutoPay S.A. (an entity providing online payment services in the field of card payments)
- Stripe
- Ereceipt – fiscal document in electronic form, the scope of which is regulated by the Act on Tax on Goods and Services of 11 March 2004, the Regulation of the Minister of Finance on cash registers and the Regulation of the Minister of Entrepreneurship and Technology on the criteria and technical conditions that cash registers must meet.
- Contract – distance contract between Client and boneIO Store (without the concurrent presence of both parties).

§4. Digital environment of the client
- To use boneIO Store and main websites, which includes possibility to buying goods and subscribe to Newsletter, client has to have:
- device with internet accessurz and modern web browser.
- Pdf viewer
- e-mail address
- to receive goods: phone number
- Seller implement appropriate technical and organisational measures to allow Client to use Store and website and protect his personal data.
- Client cannot use and send any illegal items to the Seller.
- Seller can put website under maintenance mode. Client will be informed about maintenance mode on website.
- Seller shall not be liable for technical disruptions such as server breakdowns, operating disruptions or failures of the telecommunications.
§5. Newsletter and free electronic communications services
- Seller though their website and store provide payed goods and also free digital content and services.
- There might be available services such as:
- allow client to view content of store and website. Also through search engines (digital service),
- allow client to order goods without registering in store or through e-mail (digital service),
- create and view account in store (digital service),
- View documentation of the products (digital version).
- The Agreement is concluded for an undetermined period. The agreement is for account operation and for Newsletter subscription. The agreement may be terminated any time with immediate effect. By removing account agreement is terminated. Newsletter agreement can be terminated by clicking unsubscribe link. Client can also terminate agreement through e-mail contact.
§6. Account registration in shop
- Registering in online shop is free.
- To create account Client has to fill the registration form and check required checkboxes.
- Login is possible by passing login name and password set during registration
- Client can remove account at anytime for free through remove form or through e-mail contact.
§7. The rules of making order
- Order can be placed at any time, everyday of the year.
- Browsing through available goods doesn’t require to create account.
- Client can order goods by:
- creating account (see §6 of this Terms)
- or without registering, but then he needs to fill required form
- To create order without registering:
- choose items which you want to order and click „Add to cart”
- go to cart and click „Go to checkout”
- fill order form with your personal data and shipping details,
- fill data needed for invoice,
- select one of the available payment types, accept rules and click “Place order”
- pay with selected payment type.
- To create order with account register:
- choose items which you want to order and click „Add to cart”
- go to cart and click „Go to checkout”
- at first order fill order form with personal data and shipping details and check Register box
- at next order login to shop
- fill invoice data if different than shipping details
- select one of the available payment types, accept rules and click “Place order”
- pay with selected payment type.
- Online payment is proceed on payment operator website
- After payment client is redirected back to shop website.
- After clicking „Pay now” button by client, there is agreement signed by Client and Seller.
- Client will receive through e-mail order confirmation, agreement confirmation and copy(or link) to this terms.
§8. Prices, payment and shipping methods
- Prices are available in products description on shop website.
- Prices are available in two currencies EUR or Polish zloty. Prices are available including and excluding taxes.
- The price shown for the Goods at the time the Customer places the Order in accordance with the procedure described in §7 of the Terms and contidions is binding on the parties to the transaction.
- Seller does not offer individual prices based on automated decision system.
- Full price to pay includes price for goods client ordered and shipping prices. Client is informed about full price, when creates order.
- The order processing time is counted from the moment of obtaining positive payment authorization or, in the case of choosing by the Consumer/Trader with consumer rights as the method of payment by bank transfer, from the date of crediting the Seller’s bank account.
- Client can use following shipping methods:
- courier delivery,
- paczkomaty InPost.
- Newsletter and free digital services are free to deliver.
- Client can pay for his order using followin payment methods:
- direct bank transfer to seller account,
- payment card:
- Visa
- Visa Electron
- MasterCard
- MasterCard Electronic
- Maestro
- online payments,
- mobile payments (includes BLIK),
- Detailed information about payment methods are available in order form.
- Client by making an order, agrees to send ereceipts, invoices and adjusted invoices to email address supplied in order form.
- Ereceipts
- The condition for issuing a receipt is the Customer’s consent. The Customer consents to the issuance of an e-receipt, as well as to the method of its issuance, by accepting these regulations.
- Seller issues an e-receipt to the Customer via the eparagony.pl electronic fiscal receipt system and repository
- The issuance of an ereceipt occurs through and at the moment of effective recording of the document in the document repository of the eparagony.pl system. The Customer obtains access to the document and its legible view via a unique hyperlink provided by the Seller to the Customer’s e-mail address provided in the order.
- In case of problems with access to the document or its legible view, the Customer should check the SPAM folder and contact the Seller immediately.
- The Seller may additionally send a one-time notification to the Customer at the telephone number provided by him in the order in order to inform him about the fact of issuing and issuing an ereceipt.
§9. Product complaint
- Seller must deliver goods or digital content to Client according to agreement between both parties (warranty for defects).
- If Client found product not to comply with agreement criteria then Client shall inform Seller about it, stating simultaneously a claim for compensation.
- Client fill product complaint in paper form or e-mail to addresses from §3 of this document.
- Product complaint must have identification data of the client, complaint description and what client expect Seller to do. In case document is missing some of required data seller will call client to fill out missing data. If client won’t complete complaint within 14 workdays, document won’t be proceeded anymore.
- Due data for product complaint to be considered is 14 workdays from accepted, properly filled product complaint.
- No anwer from the seller within the prescribed deadline menas that seller accepted by the seller.
- If client is not Consumer or Trader with consumer rights, warranties for physical and legal defects is hereby expressly excluded in all cases by the seller (art. 558§1 Polish civil code).
§10. Right of withdrawal
- Client has right of withdrawal within 14 workdays if distance contract was agreed between Client and Seller. Due date is counted from the day when order was delivered to shipping address, specified in order form.
- In order to meet the withdrawal deadline, Client has to inform Seller in written form that he/she uses this right.
- Right of withdrawal doesn’t apply to Client if:
- Client accepted contract for providing services which Seller performed and Seller informed client that he’d lost right of withdrawal. Client is required to pay agreed price.
- Subject matter of the contract is goods made specially for the client, in accordance with client specification; in order to meet client individual needs;
- In order to use right of withdrawal which are not mentioned before Client shall inform Seller about his will to use right of withdrawal using e-mail or letter (address in §3 of this rules) in form of written declaration.
- Consumer and Trader with consumer rights can use our template, which is attached to this document. It is not mandatory. Address to ship products is available on e-mail request or at Refund and Returns Policy.
- In the event of withdrawal from the Agreement, the Seller returns all payments received, no later than 14 days from the date on which the Seller was informed about the withdrawal from the Agreement by the Consumer or Trader with consumer rights. The Seller will refund the payment using the same payment methods that were used in the original transaction, unless the Consumer/Trader with consumer rights has expressly agreed to a different solution that will not involve any costs for him/her.
- The Seller may withhold the refund until delivery of the returned Goods or confirmation of its shipment (whichever comes first).
- The consumer covers all direct costs of returning the Goods, including the cost of packaging and shipping.
- The Consumer/Trader with consumer rights is responsible for reducing the value of the Goods resulting from using the product in a way that goes beyond what is necessary to determine the nature, characteristics and functioning of the Product.
- In the event of withdrawal from the contract for the supply of content or Digital Service, the Consumer/Trader with consumer rights are obliged to stop using the content or Digital Service and make them available to third parties.
§11. Out-of-court methods of resolving consumer disputes
- The Seller agrees to submit any disputes arising in connection with concluded distance contracts to mediation proceedings. The details will be determined by the parties to the conflict.
- If the undertaken mediation proceedings are unsuccessful or the parties do not decide on them, and the Client is not a Consumer or an Trader with consumer rights, the court competent to resolve any disputes related to such a contract is the court competent for the registered office of the Seller.
- The consumer has the right to use out-of-court methods of dealing with complaints and pursuing claims. Among other things, the Consumer has the opportunity to:
- The consumer has the option of using out-of-court complaint and claim settlement methods. Among other things, the consumer has the option of:
- submitting a request to a permanent consumer arbitration court to resolve a dispute arising from the concluded contract,
- submitting a request to the provincial inspector of the Trade Inspection to initiate mediation proceedings to resolve the dispute amicably,
- using the assistance of a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection.
- The consumer may also submit a complaint via the EU ODR online platform, available at: https://ec.europa.eu/consumers/odr/.

§12. Copyright
- The digital content available on the Website, as well as the materials included in the Digital Goods and Services, are works and are protected by copyright, and these rights are vested in the Seller or persons cooperating with him and who have granted the Seller appropriate licenses.
- The customer may use the above-mentioned content on the basis of fair private use. This means that the Customer and users of the Website may use them only for their own needs, including their business activities, provided that the buyer is not entitled to make them available to third parties as their own product or service (for a fee or free of charge).
- Customer interested in wider use of the above. content should contact the Seller and undertake individual negotiations.
- Unauthorized distribution of the above. content may result in civil and criminal liability.
§13. Personal data and cookies
- The principles of personal data processing and the use of cookies are described in the Privacy and Cookies Policy available at Privacy Policy
§14. Final Provisions
- Contracts concluded by the Seller are concluded in Polish or in English if necessary.
- The Seller reserves the right to make changes to the Regulations for important reasons, i.e. changes in legal provisions, changes in payment and delivery methods, to the extent that these changes affect the implementation of the provisions of these Regulations. The changes are effective on the date of publication of the new regulations. The changes do not apply to contracts concluded before the changes to the Regulations were introduced.
- In matters not regulated in these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Consumer Law Act, the Civil Code; Entrepreneurs’ rights; the Act on the Provision of Services by Electronic Means, the General Data Protection Regulation (GDPR) and the Personal Data Protection Act.
- The Regulations apply to contracts concluded from January 1, 2024.
